On Some Methods of Falsifying the Results of Operational Investigative Activities

Abstract

The method of committing a crime is a significant element of the forensic characteristics of crimes. The author analyzes certain scientific papers and judicial practice, some of the most common methods of falsifying the results of operational-search activities. The employees of the operational-search bodies can relatively easy mislead the investigators, prosecutors and judges, as well as transform and modify the results of operational-search activities presented both in digital form and in the form of operational-official documents.It is noted that the falsification of the results of the operational-search activities can be complete or partial. The circumstances of the complete falsification of the results of the test purchase are given as an example. The features of partial falsification are indicated, in which the employees of the operational-search bodies refer to the information they have on the case, without indicating its source. The main methods of falsifying the results of the operational-search activity are the following: planting drugs, bribes and other objects by police officers in the course of certain operational-search activities; creation of traces of a crime that do not correspond to reality using special chemical and other substances; attachment of unreliable operational documents to the case; replacement of the results of the search warrant when they are presented to the investigator with other results of the warrant, which may be distorted.
