Специфика задач, функций и направлений деятельности прокуратуры по обеспечению законности в чрезвычайных ситуациях: проблемы теории и законодательства.

Abstract

Currently, at the federal level, issues of preventing and eliminating the negative consequences of emergency situations are extremely relevant. This is due to two factors: firstly, a significant number of them, and secondly, significant material losses. In addition, no less important is the issue related to ensuring the rights and freedoms of citizens in these conditions. A special role in this issue is played by specific government bodies, whose activities are aimed at eliminating the negative consequences of emergency situations. Special attention was paid to the issues of determining the list of tasks of the prosecutor's office in emergency situations. It has been established that a significant part of these tasks are temporary. However, their implementation involves changing the mode of functioning of employees of the prosecutor's office, changing the organizational forms of activity of the prosecutor's office (creating an operational headquarters, organizing the work of mobile and temporary reception rooms, creating a mobile task force, creating an interdepartmental working group). Based on the analysis, the author has identified the specific tasks of the prosecutor's office in emergency situations, which include: protection and restoration of the rights of affected citizens; taking appropriate measures aimed at preventing shortages of essential goods and food products; ensuring targeted spending of budget funds, etc.

Some attention is paid to the analysis of scientific approaches regarding the definition of the concept of “functions of the prosecutor’s office”. It has been established that today this concept can be confidently classified as debatable. Based on the scientific heritage, it was found that most scientists include the following elements in the concept of “functions of the prosecutor’s office”: firstly, they are based on general and special tasks; secondly, the presence of a subject of jurisdiction characteristic exclusively of the prosecutor’s office, i.e. powers; thirdly, it requires the use of inherent powers and legal means. Based on the analysis, taking into account the specifics of social relations arising in emergency situations, the specifics of the external functional activities of the prosecutor's office were determined, therefore, the substantive side of the functions and areas (areas) of the activities of the prosecutor's office in emergency situations.
