Abstract

The relevance of the issue under consideration is caused by the need for scientific understanding and objectification due to the lack of understanding in science and practice of the principle of cost of legal regulation, the lack of a formally defined list of principles of cost of legal regulation necessary for the most high-quality and effective regulation of social relations.

The article analyzes scientific sources and existing legislation on the rules for preparing normative legal acts, as well as the procedure for assessing legal regulation. Based on the analysis carried out, for the first time in scientific research, the concept of the principle of cost of legal regulation was formulated, a classification was given and characteristics of the principles were given. The author includes among the principles of the cost of legal regulation, in addition to general legal principles: the principle of universality, the principle of utility, the principle of balancing the cost of legal regulation, the principle of compromise between the assessment of resource expenditures on the legal regulation of relations and income in the form of financial revenues to the budget in combination with the social utility of this regulation, the principle of transparency in assessing the cost of legal regulation, the principle of optimizing the cost of legal regulation.The author has formulated recommendations for the formal expression of the principles of cost of legal regulation in the Federal Law of December 21, 2021 No. 414-FZ, as well as in the Decree of the Government of the Russian Federation of August 13, 1997 No. 1009. In addition, the author comes to the conclusion that some the provisions that exist within the framework of the mechanism for assessing standard costs of subjects of business and other economic activities require enshrinement in acts of greater legal force.
