Pregnancy as a legal fact in social security law

Abstract

The author has made an attempt to consider pregnancy as a legal fact from the point of view of
its signs, structure, functions, emphasized in legal science (in general legal and sectoral aspects).
The works on the theory of law and social security law are chosen as a basis. The belonging
of pregnancy as a legal fact to the category of a legal fact-state is analyzed. Having studied the
works of domestic researchers, the author proposes a normative model of pregnancy as a legal
fact, and comments on the ideological and real models of pregnancy as a legal fact-state. The paper
takes into account the division of legal facts into grounds for social security and prerequisites
for social security legal relations, which is traditional for the science of social security law. The
rules of normative legal acts in the relevant field have also been considered. The author concludes that
the task of the branch science is to determine the cases in which the state of pregnancy should be a legal fact of the first or the second category in accordance with the objectives of the branch
